City permit or county permit? Check the parcel, not the mailing address.
Punta Gorda is Charlotte County's only incorporated city, and that decides who reviews your pool. Inside city limits, the City of Punta Gorda Building Division issues the permit, and the City's Zoning Division applies the setbacks in Chapter 26 of the City Code. Outside city limits, including Port Charlotte and the unincorporated Burnt Store Road corridor, the permit goes to Charlotte County Community Development.
A Punta Gorda mailing address doesn't settle it. Charlotte County's FAQ gives the test: look up the parcel on the Charlotte County Property Appraiser site and read the "Taxing District" field. Tax districts 149 through 156 mean the property is inside the city. Any other district means county jurisdiction; follow the Charlotte County pool permit process and our Port Charlotte guide.
Inside the city, three things work differently:

Two credentials. The City's pool application asks for the contractor's state license number and a City certificate number. The Building Division will confirm a contractor's City registration.

No online filing. The City's online permit system is view-only. Its Building page says customers can't apply for building permits online.

Neighborhood zoning. Much of Punta Gorda Isles sits in a Special Residential Overlay with its own pool, fence and setback rules.
On a canal lot, the pool plan starts at the seawall.
The City maintains 45 miles of canals and 91 miles of seawall, split into two assessment districts: Punta Gorda Isles (PGI) and Burnt Store Isles (BSI). The City's Canal Maintenance Division inspects and replaces City-maintained seawalls, and that shapes where a pool can go.
The 20-foot line in Punta Gorda Isles
Under §3.13(d) of Chapter 26, the Special Residential Overlay allows pools, patios and pool cages in rear yards to within 20 feet of a waterway or golf course, provided the house keeps its 25-foot front setback. On most canal lots, that 20 feet is the biggest limit on pool size.
The six feet behind the seawall stays open
The City asks owners not to attach anything to the seawall or its cap, and to keep 6 feet behind the cap clear so crews can inspect and reach the wall. In the overlay, §3.13(e) requires at least 6 feet of sod against any seawall and bars drainage layouts that push hydrostatic pressure against it. Design the deck drainage with that in mind.
Outside the overlay, the zoning district decides
Elsewhere, §8.15 requires screened enclosures to meet the zoning district's yard setbacks. In the GS single-family districts, for example, the minimum rear yard abutting a waterway is 25 feet (§3.4(g)(4)). The City's Zoning Division (941-575-3314) confirms setbacks by parcel.
Ask where your seawall stands
Hurricane Ian in 2022 left hundreds of canal-front parcels with seawall damage, and the City has been replacing failed sections since; each replacement typically takes three to four weeks. Before you lock in a layout, ask Public Works (941-575-5050) whether your section is scheduled.
Punta Gorda Isles and Burnt Store Isles use different rulebooks.
Punta Gorda Isles: the rules live in City code
According to the Punta Gorda Isles Civic Association, PGI's original deed restrictions weren't renewed in 1995. The standards moved into the City code as the Special Residential Overlay, which §3.13 applies to platted Punta Gorda Isles Sections 1–12, 14, 15, 17, 18, 24, 26 and 27. For a pool, that means:
- No above-ground pools (§3.13(p)). Any pool whose top sits more than 12 inches above finished grade counts as above-ground. A pool built within concrete stem walls doesn't.
- Fence limits. Panels can be no taller than 48 inches and posts no taller than 54 inches. Fences aren't allowed in front yards, and uncoated or slatted chain link is prohibited. A pool-barrier fence may meet the state minimums in Chapter 515, F.S. (§3.13(m)).
- Equipment placement. Pool equipment may encroach up to four feet into a recorded drainage or utility easement, but no permanent structure may sit in an easement in use (§3.13(t)).
Burnt Store Isles: deed restrictions plus the City
BSI's deed restrictions are recorded (Charlotte County Official Records Book 328, pages 85–91). According to the Burnt Store Isles Association, they require BSIA Board approval before changes to a property's exterior appearance or land use, member or not. BSIA has also adopted a policy allowing a pool, patio or cage to a 20-foot setback on canal and golf-course lots. That's on top of the City permit and zoning.
Gated communities and HOAs
Mandatory HOAs are governed by Chapter 720, F.S.; under §720.3035(1)(a), architectural review reaches only as far as the declaration of covenants states or reasonably implies. A harbor town that has seen Charley and Ian.
The National Hurricane Center's report on Hurricane Charley records the eye passing over Punta Gorda on August 13, 2004, with the eyewall striking the city and Port Charlotte "with devastating results." Ian followed in 2022. For a pool, that means:

Floodplain review. The City's floodplain application asks for the base flood elevation (BFE) and plans showing existing and proposed elevations.

Pool equipment. Per Florida Division of Emergency Management guidance on the 8th Edition (2023) Florida Building Code, equipment not rated for submersion may sit below BFE plus freeboard only if elevated as far as practical, anchored, and GFCI-protected.

Harborfront lots. In Zone VE or a Coastal A Zone, FBC-Residential §R322.3.3.1 requires the pool to comply with ASCE 24. An engineer designs it to be elevated, break away, or stay in the ground without obstructing flood flow.

Insurance. NFIP flood policies expressly exclude swimming pools. Ask your agent how the pool, deck and cage are covered.
What the City of Punta Gorda asks for at submittal.
The Building Division publishes a Swimming Pool Spa Package and a Pool Barrier Compliance Checklist on its Building Forms page. The package and Chapter 26 call for:

Application and Notice of Commencement. A certified NOC copy is required for work valued over $5,000, unless the pool is already on a new home's contract and NOC.

Two signed and sealed surveys: original boundary surveys less than one year old (§6.9(a)).

Two plot plans showing setbacks, with the total impervious-area calculation, plus complete drawing sets.

Pool barrier form signed by contractor and owner, naming the §515.27, F.S. safety feature. City code §8.15 also requires a fence or wall at least four feet high, or a screened enclosure.

How do I know if my address is inside Punta Gorda city limits?

Can I pull a Punta Gorda pool permit as an owner-builder?
Yes, but the City's owner-builder affidavit must be signed in person at the Building Division. Under §489.103(7), F.S., selling or leasing within one year of completion creates a presumption the work was done for sale.
Does one Punta Gorda permit cover the pool, cage and fence?
